Micronesia Property: FSM Land Title and Defined-Term Lease Questions

Understand FSM constitutional land-title and indefinite-lease restrictions, identify the relevant state and organise advice on the actual offered interest.

By MarkMyProperty · Updated

Coverage: Federated States of Micronesia constitutional text and Yap public-land code as state-specific background; this guide does not determine applicant eligibility, valid lease terms or current state procedures.

Apply the national constitutional distinction first

The published Constitution of the Federated States of Micronesia, Article XIII, distinguishes land-title acquisition from leasing. It prohibits title acquisition by a noncitizen or a corporation not wholly owned by citizens. It also prohibits indefinite-term land leases by those parties or any government.

Use these provisions as a starting point for qualified advice on the actual applicant and offered interest. Do not assume a listing’s wording establishes a right to acquire or that a company structure removes the constitutional question. The adviser must assess the proposed parties and transaction.

Identify the state and competent authority

Record whether the candidate property is in Chuuk, Kosrae, Pohnpei or Yap. National constitutional limits do not supply a single complete transaction procedure for every state and tenure. Ask the local adviser which records, authorities and permissions govern the actual interest.

Keep the property description, documentary references, parties and proposed right together. An offer of occupation rights or a lease should not be relabelled as an outright land-title sale merely because the brochure uses the word “ownership.” Compare equivalent interests before comparing prices.

Use state-specific material within its scope

The publicly available Yap State Code chapter on public land describes the State’s trustee role and specific public-land dealing arrangements. This is Yap public-land background, not a private-land or nationwide lease checklist. Ask which current state law and competent authority apply to the actual property.

For any proposed lease, ask the lawyer to explain the defined term, lessor authority, conditions, required approvals and appropriate record evidence. A defined term alone does not establish that a particular lease is valid or suitable. Confirm current requirements and avoid relying on an old code page for present fees or processing periods.

  • Identify the applicant and constitutional title/lease question.
  • Record the actual state and tenure.
  • Obtain advice on term, authority, approvals and record evidence.

Fictional interest-and-state worksheet

The adviser clarifies the proposed right before comparing offers

A noncitizen buyer receives an offer labelled “ownership” whose supplied document is a lease outline. The adviser identifies the state, actual tenure and constitutional issues, then asks for the term, lessor authority and applicable current requirements.

The worksheet keeps the outline as a proposal rather than a valid registered interest. It does not assume that a defined term grants eligibility or import Yap public-land arrangements into another state.

Complete the site and intended-use checks

Arrange appropriate boundary, access, occupation, condition and intended-use enquiries. Ask which constitutional, tenure and permission matters affect commitment. A listing description or general legal text cannot inspect buildings or establish seller authority over the actual interest.
