Strata Title vs Master Title in Malaysia: Checks Before Buying an Apartment

Understand a Malaysian apartment’s strata-title stage, parcel and accessory rights, and the transfer questions to ask the developer, land office and lawyer.

By MarkMyProperty · Updated

Coverage: Malaysia; this guide uses JKPTG’s strata framework. Confirm the relevant state law, land office and any Sabah or Sarawak differences.

Ask what document identifies the apartment

A master title concerns the parent land, while a strata title identifies a parcel within a strata scheme. JKPTG describes the strata title as the document issued by the relevant state land authority for an individual parcel. Ask the seller which title stage applies to the apartment being offered and request the supporting evidence.

A statement that the building is completed does not establish that the unit’s strata title has been issued or transferred to the seller. Write down the land reference, parcel number, building and unit details. Have a Malaysian conveyancing lawyer explain which rights and documents support the proposed transaction at that stage.

Separate title issuance from transfer to the buyer

JKPTG’s guidance explains that an issued strata title can initially be registered in the developer or land proprietor’s name. Issuance and the later transfer to the purchaser are distinct steps. Ask whose name appears in the current record and what remains to be completed for the seller’s ownership and your intended transfer.

For the relevant transfer, JKPTG identifies the Form 14A process under its applicable framework and advises using the appointed lawyer. Do not infer that possession, a sale agreement or a developer’s notice automatically means the title has already changed names. Obtain the lawyer’s transaction-specific document and consent checklist.

  • Identify the parent land and individual parcel.
  • Confirm whether strata title is pending, issued or transferred.
  • Check the current registered name.
  • Ask which transfer, consent and release documents remain.

Check parking, storage and common-property rights

Match the apartment and any accessory parcel to the title, strata plan and sale documents. Ask how parking or storage is legally included. A space shown during a viewing might have a different basis from an accessory parcel recorded with the unit, so keep that distinction in the offer comparison.

Review the scheme’s management information, charges, arrears and significant planned work separately. Title documentation and the cost of participating in the scheme answer different questions. Ask about restrictions relevant to intended letting or alterations, and have any inconsistent unit description or share information investigated before signing.

Title issued, transfer still outstanding

A seller says the strata title has arrived but provides a notice rather than a record showing the seller as proprietor. The buyer asks the lawyer to confirm the title, current name and outstanding transfer steps.

The buyer records those answers separately from possession and the loan application. The transaction timetable is then discussed using the actual stage instead of treating the words strata title available as completion of every transfer.

Confirm the state office and completion sequence

JKPTG directs strata-application status questions to the relevant state land authority. Ask which office handles the scheme and retain the official reference and date. If the developer’s position or title application is unclear, have the lawyer identify the appropriate enquiries and what evidence is needed to proceed.

Browse Malaysia apartment listings by location and stated offer, then compare title stage, included parcels and total costs on a consistent basis. MarkMyProperty does not certify Malaysian title issuance or transfer. Its map assists location comparisons while the official record and professional review address the legal interest being offered.

Frequently asked questions

Does a completed apartment building mean my strata title is transferred?

No. Completion, title issuance and transfer to a purchaser are separate stages to check.

Where should I check a strata-title application’s status?

Use the relevant state land authority identified for the property, following JKPTG’s guidance and your lawyer’s advice.

Is every advertised car space an accessory parcel?

Do not assume so. Match the plan, title and transaction documents to the rights actually included.
