Albania Property Buying: Legalised Building and Land Ownership Checks

Prepare questions about an Albanian legalised building, its land and ASHK documents, and distinguish a legalisation decision from the completed property file.

By MarkMyProperty · Updated

Coverage: Albania ASHK document preparation, including its published process for eligible building-plot beneficiaries; the applicable decision and property position must be checked individually.

Ask what each supplied document establishes

A seller’s legalisation document can be an important part of an Albanian property file, but first ask what it describes. Keep the building, underlying land and any additional area on separate worksheet lines. Do not assume the label on one document answers every ownership question about the advertised property.

ASHK’s 2026 guidance for eligible building-plot beneficiaries describes a process involving acquisition of the building plot and subsequent joining of building and land into a single ownership certificate. Use this published example to identify questions, rather than assuming that every legalised building has the same unfinished or completed process.

Connect the decision with the property identifiers

Request the relevant legalisation decision, current ownership evidence and cadastral identifiers from the seller. Ask your transaction adviser to connect the documents with the actual building and land offered. If references or areas differ, preserve the difference in your file until the documents explain it.

For the ASHK beneficiary process described in its guidance, ask which steps have actually been completed and which evidence records them. A payment request, payment receipt and final property document belong at different stages. Do not collapse them into one generic label of completed ownership.

  • List building and land references separately.
  • Keep the legalisation decision with subsequent documents.
  • Record completed steps and unresolved questions with evidence.

Use the relevant current cadastral service

ASHK publishes guidance about automated cadastral services through e-Albania. Use the official service appropriate to the document you need and the applicant’s authority. Follow current instructions, and ask the seller or adviser to obtain documents that you are not entitled to request yourself.

Preserve the electronic result and its context rather than relying only on a printed screenshot. If the service requires additional information or the record cannot be matched, keep the enquiry unresolved. An online application is evidence of a request, not a substitute for its final result.

Fictional example: a building document without the land explanation

This original exercise does not assess an Albanian property or a beneficiary decision.

Fictional document chain

The plot step remains unexplained

A buyer receives a legalisation decision for a building, while the advertisement also describes the surrounding land as included. The buyer asks for the documents explaining the land position and any subsequent ownership-certificate steps.

The adviser is asked whether the seller’s file is complete for the proposed transaction and what further evidence is needed. Until those questions are answered, the buyer does not convert the advertised garden extent into a confirmed transfer of land.

Complete the physical and transaction investigation

Arrange appropriate condition, boundary, access and use enquiries for the particular property. Keep the cadastral and legalisation documents alongside those answers. A document about one administrative process does not inspect the building or settle every intended-use question.

Browse Albania properties using the country links below and compare equivalent interests and inclusions. Keep dated evidence and missing documents visible before signing or paying. MarkMyProperty helps discovery; it does not certify legalisation completion, land ownership, boundaries or transaction eligibility.

Frequently asked questions

Should I check the land separately from the legalised building?

Ask the adviser to explain both positions and connect them with the proposed sale. ASHK’s published beneficiary process illustrates why subsequent land and certificate steps can matter.

Does this process apply to every Albanian home?

No. Check the particular documents, decision and eligibility; the article uses a specifically published ASHK process to frame enquiries.

Does an e-Albania application prove the document was issued?

Keep the request and final electronic result separate, and ask for the actual document needed for the transaction investigation.
