The search is tatimi on a sale of a home
On 2 November 2026, Official Journal No. 70 of 2 May 2023 was fetched. It publishes Law No. 29/2023 of 30 March 2023 on income tax. Article 15(1)(d) includes a capital gain from the alienation of immovable property in investment income. Article 24(3) says investment income is taxed at 8 percent for dividends and at 15 percent for every other item of investment income. Article 24(4) says that, except where the law provides otherwise, no cost is deducted against investment income.
Article 17(1) says taxable investment income from the alienation of property is the difference between the sale price and the purchase price. Article 17(2) says the purchase price, in relation to non-taxable investment income from the alienation of immovable property, cannot be deducted from the tax base. Article 17(5) says the sale price of immovable property is assessed at the higher of the contract price and the reference price set in the acts in force. Article 17(7) says the personal income tax on investment income from the alienation of immovable property is paid by the natural person who transfers the ownership, before the property is registered. The institution that keeps the register does not register the property until payment of the tax is confirmed. The law’s closing article says it enters into force 15 days after publication and takes effect from 1 January 2024, except article 69(1)(ç). This page does not set out that exception.
An agricultural-land transfer has its own exclusion
Article 15(2)(b) excludes, from investment income, income from the transfer of ownership of agricultural land when the legal successor keeps the land for the same purpose and activity. Article 17(6) says an exchange of a plot for construction area, under an exchange contract, is not a moment for calculating a capital gain from the transfer of immovable property. The methodology for the purchase price and the sale price in that case is set by a decision of the Council of Ministers. The fetched journal does not print that decision.

Those sentences are that publication of Law No. 29/2023. They are not the legalisation guide, which was not rewritten. A pin or a contact reveal does not establish title, and a contract price is not by itself the sale price when the reference price is higher. This page does not set out a payment.
