Tuvalu Property: Native Land, Lease Registers and Plan Documents

Distinguish Tuvalu native-land records, lease approval and registration evidence and site plans, using scoped official legal and project documentation.

By MarkMyProperty · Updated

Coverage: Tuvalu Native Lands Act 2022 revised edition and May 2024 Funafuti project documentation as background; current land rights, eligibility and requirements need island-specific local advice.

Identify the island and the proposed right

Tuvalu’s government legal database publishes the Native Lands Act in a 2022 revised edition. It distinguishes court records, native leases and other leases or subleases of native land. Those distinctions make the island, parties and proposed right essential parts of a property enquiry.

Collect the land name or reference, island, area described, actual proposed agreement and any existing record details. Ask the adviser which category applies and which authority’s record is needed. Avoid turning a general description such as “family land” or “lease available” into a conclusion about valid rights.

Keep approval and registration evidence together

Part VI of the published Act addresses approval and registration of leases, with different provisions for native leases and other lease arrangements. It describes register entries and endorsements recording approval and registration. These are useful documentary questions; a signed private draft should not simply be labelled as an issued register record.

Ask for the actual approval and registration evidence for the relevant category, with dates and references. Obtain advice on the current legal requirements and the person’s authority to grant the proposed interest. This guide does not determine eligibility, valid terms or the result of an application.

Treat project documents as project background

The Public Works Department hosts a May 2024 Funafuti Water Supply and Sanitation Project resettlement plan, including land-lease documentation and mapped project areas. It illustrates why a file should distinguish the agreement, its described land and the project purpose.

That report concerns a particular public infrastructure project. Its examples and safeguards are not a universal private-property transaction process, fee schedule or confirmation that works or services now exist at an advertised site. For another property, obtain its own relevant agreement, record and plan through the competent channels.

A fictional lease-and-plan review

Imagine a prospective occupier is shown a lease draft and a map highlighting an area near Funafuti. Their worksheet separates land reference, proposed leased area, access route, draft date and any claimed registration details. A nearby project map is retained as context, not as the offered land’s title evidence.

The adviser is asked to reconcile the proposed area with the correct record and identify the necessary approval and registration documents. If the draft concerns only part of a parcel, that scope remains explicit. This original example organises questions; it is not approval of a real lease or a promise about any applicant.

Ask about the actual site and obligations

Alongside land-record work, arrange suitable enquiries about boundaries, access, building condition, intended use and the agreement’s continuing obligations. Confirm what services the site actually has and what evidence supports the answer. A public project plan does not inspect an individual dwelling.

MarkMyProperty’s listings and map pins support discovery; they do not establish customary ownership, lease approval, registration, buyer eligibility or a completed transaction.

Frequently asked questions

Is a signed draft evidence of completed registration?

Ask for the applicable approval, register reference and endorsed or issued documents rather than assuming the stages are complete.

Can I use the Funafuti project report as a private-purchase checklist?

No. Its documentation concerns a specified public infrastructure project and is used here only as background.

Why does the lease category matter?

The published Act distinguishes arrangements and associated records. Obtain advice on the category that actually applies.
