Nota Simple in Spain: What to Check Before Buying a Property

Read a Spanish nota simple for property identity, registered rights and burdens, distinguish it from certification, and prepare the notary’s purchase questions.

By MarkMyProperty · Updated

Coverage: Spain; use the competent Property Registry and the actual registered property. Legal, planning and regional transaction requirements need separate review.

Identify the registered property behind the address

A nota simple informativa provides information from the Spanish Property Registry about an identified registered property. Ask for the correct finca and registry references rather than searching only a building address. An apartment, parking space and storage unit may require clarification of their separate or associated registered descriptions.

The Spanish registrars describe information including property identification, holders of registered rights and relevant limitations or burdens. Match the record to the seller’s offer and have the actual entries explained by your adviser. A short marketing description cannot tell you which legal interest is registered or included in the sale.

Read ownership and burdens together

Compare the recorded right holders with the people signing the agreement and ask about any representation, joint ownership or other authority requirement. Review relevant mortgages, usufruct or other entries shown by the record. If the seller says a burden will be released, ask how the notary and registry will document the clearance.

Keep the issue date and scope visible. The registrars’ guidance notes that the legal situation can change after the nota simple is issued. Ask when updated information will be obtained for completion and how that fits the notarial process; an old translation should not remain your only current record.

  • Match finca, unit and relevant associated rights.
  • Compare registered holders with the seller’s authority.
  • Identify entries needing interpretation or release evidence.
  • Record the issue date and required update stage.

Distinguish information from registry certification

The registrars explain that a nota simple has an informational purpose, while registry certification has a different evidential status. Ask which form your lawyer, notary, lender or other recipient needs for the specific task. Do not relabel an informal extract as a certificate simply because it carries registry branding.

Where a translation is supplied, retain the original Spanish record and the date of issue. The official translation-service guidance identifies the underlying Spanish information at the time it was issued. Ask the adviser to resolve unclear legal terms instead of treating a convenient English paraphrase as the full explanation of the right.

A fictional parking-right comparison

This is a document-identification example, not a legal finding about a Spanish property.

Purchase worksheet

An apartment extract and a separately offered garage

An apartment advertisement includes a garage, but the supplied nota simple describes only the apartment. The buyer asks whether the garage is a separate registered property or included through another documented right.

The buyer then requests the relevant evidence and has the adviser connect it to the price and deed. The apartment’s record is not expanded into proof of an undocumented parking interest.

Complete checks beyond the registry extract

Review building condition, relevant planning and occupation evidence, community costs and other local requirements through the appropriate professionals. The registered legal description, cadastral information and physical home can require reconciliation. A nota simple is useful evidence without being a certificate that every aspect of the purchase is safe.

Browse Spain listings by location and type, then request the correct record for the shortlisted offer. MarkMyProperty does not issue nota simple or registry certification and does not verify title. Its map supports comparisons while the registry, notarial process and professional checks investigate what is actually being transferred.

Frequently asked questions

Is a nota simple the same as registry certification?

No. The registrars distinguish the informational extract from certification. Ask which form is required for the actual purpose.

Can I rely on an old nota simple throughout the purchase?

Ask when updated information is needed. The registered situation may change after the extract is issued.

Does an apartment’s record always cover advertised parking?

Do not assume so. Establish the separate or associated registered right and include the appropriate evidence in the transaction review.
