Fiji Property Buying: Freehold, Lease Transfer and TLTB Consent

Identify Fiji’s freehold and lease-transfer document categories, establish the relevant consent authority and ask about lease compliance before commitment.

By MarkMyProperty · Updated

Coverage: Fiji Ministry of Justice transfer catalogue and TLTB July 2026 lease-compliance notice; actual tenure, applicant eligibility, consent and registration requirements need individual advice.

Identify freehold title or the actual lease

Fiji’s Ministry of Justice publishes separate transfer categories for freehold Certificates of Title and leases. Start with the actual instrument supplied for the offer. Ask the lawyer whether the price concerns freehold, a lease interest or another specified right.

Collect the title or lease references, land description and included improvements. If it is leasehold, keep the actual term, parties and conditions available for advice. Do not compare the advertised price with a freehold offer until the difference in rights and obligations is understood.

Identify the relevant consent authority

The Ministry’s lease-transfer guidance lists consent from the applicable authority, including iTLTB, Director of Lands, Housing Authority or Methodist Church lease authority as relevant. It separately identifies a Minister for Lands consent question for freehold transfers subject to the Land Sales Act.

Ask which consent applies to the actual instrument and proposed dealing. A request for consent, an issued consent and registration evidence are different stages. Keep their references and conditions separate and ask how any outstanding stage affects the proposed contract.

Ask about compliance for a TLTB lease

TLTB’s July 2026 notice reminds tenants to comply with lease conditions, permitted-use requirements and rental obligations. It explains that identified breaches must be remedied before TLTB can consider the requested consent in the circumstances it describes.

Use this notice to ask precise compliance questions for an iTaukei lease rather than assuming consent is automatic. Request the adviser’s explanation of the actual lease obligations, any outstanding matter and relevant approvals. The Ministry also lists tax and identification documents in transfer categories; confirm the current applicable packet and charges rather than using this article as filing instructions.

  • Identify freehold or the exact lease interest.
  • Ask which authority and consent govern the proposed dealing.
  • Keep compliance, consent and registration evidence separately.

Fictional example: an unresolved lease-compliance question

This original exercise does not determine a Fiji lease, breach or consent application.

Fictional lease-transfer worksheet

The buyer clarifies the outstanding matters before relying on consent

A leasehold offer includes an earlier consent request. The lawyer checks the actual lease, applicable authority, compliance position and evidence of the request’s outcome.

The worksheet does not relabel a pending request as approved consent or assume that a later registered transfer exists. It compares the offer with other leasehold interests using the actual term and conditions.

Complete the site and applicant enquiries

Arrange appropriate boundary, access, building-condition and intended-use checks. Ask the lawyer to establish acquisition eligibility and current requirements for the actual parties and property. Registry guidance does not inspect improvements or give every applicant permission to acquire.

Use Fiji’s country property links below to compare equivalent rights and components. MarkMyProperty’s listings and map pins support discovery; they do not certify freehold ownership, lease compliance, TLTB consent, buyer eligibility, tax clearance or registered completion.
