Dominica Property Buying: First Title, Replacement and Transfer Evidence

Distinguish Dominica’s first-title application, replacement-title and transfer categories and organise the survey and issued-document enquiries for an offer.

By MarkMyProperty · Updated

Coverage: Commonwealth of Dominica government Certificate of Title and Registry guidance; current procedure, property rights and acquisition requirements need individual legal advice.

Clarify which title category the seller means

The Commonwealth of Dominica government’s first-title guidance distinguishes a first Certificate of Title, a replacement for a lost or destroyed title and a transfer involving registered land. Start by asking which category applies to the actual offer.

The word “new” in a conversation or brochure can be ambiguous. Request the actual documents and ask the lawyer whether they concern first registration, replacement or a transaction with an existing registered interest. Keep the property description and proposed right alongside that answer.

Understand why a first-title application needs a history

The public guide describes supporting survey plans, affidavits about the land and claimed right, other supporting documents and an abstract of title. These categories show why a first-registration enquiry involves more than a receipt or a marketing statement.

Ask the lawyer to identify the available evidence, the actual application stage and any outstanding matters. The guide also describes notice and advertisement stages. Confirm current requirements and their application to the case; this article does not prescribe fees, deadlines or a complete application packet.

Separate a request from the issued certificates

The government guidance explains that the issued title is produced in duplicate, with one retained at the Registry and another supplied to the registered proprietor. Keep the application documents and issued-title evidence as separate stages in your worksheet.

The Registry Division’s official functions include registration and delivery of Certificates of Title. Ask the competent office and lawyer which current record or copy establishes the position for your offer. A statement that papers have been lodged does not identify every step still needed before the appropriate title evidence can be supplied.

  • Identify first registration, replacement or transfer precisely.
  • Connect survey and supporting history to the offered land.
  • Keep lodgment, notices and issued-document evidence separately.

Fictional example: a brochure says new title

This original scenario does not determine a title or claim in Dominica.

Fictional title-stage worksheet

The buyer clarifies why the document is new

A buyer receives a brochure saying “new title being arranged.” The lawyer asks whether this means a first registration, a lost-title replacement or the buyer’s proposed transfer, and requests matching references and supporting evidence.

The worksheet records the actual category and stage when established. It does not assume that the advertisement’s wording means a first registration has already completed or that an existing registered interest is absent.

Match the documentary enquiry with site checks

Arrange appropriate boundary, access, condition and intended-use investigations. Ask which outstanding title or application matters affect commitment and the proposed contract. A survey supplied for an application does not by itself answer every question about present structures, access rights or development permission.
