Chile Property Buying: Santiago Dominio Vigente and Gravámenes

Prepare Santiago registry references for a current ownership copy and the separate encumbrance enquiry, with scope and document questions for buyers.

By MarkMyProperty · Updated

Coverage: ChileAtiende guidance for the Conservador de Bienes Raíces de Santiago; properties handled by another conservador require that office’s appropriate services.

Identify the conservador and inscription

ChileAtiende’s current guidance explains the copia de inscripción con vigencia, commonly called dominio vigente, through the Conservador de Bienes Raíces de Santiago. First establish that this is the competent conservador for the property. The service description should not be read as identical instructions for every Chilean location.

The request uses fojas, número and año of the property inscription. Collect those references from the seller’s documents and confirm which unit or parcel they describe. A street address or development name helps you locate an offer, but it is not a substitute for its registry references.

Understand the current-ownership document

The official description presents the copy with vigencia as evidence of the current property inscription. Read the document with your adviser and match its description and parties to the proposed acquisition. If the inscription references are unknown, ChileAtiende explains using the conservador’s index enquiry to identify them.

Ask for clarification when an advertised accessory or additional parcel is not clearly connected with the document. Keep the date and exact service name on your worksheet. Do not shorten every copied inscription to “title checked” without recording what was actually supplied.

  • Confirm the competent conservador.
  • Record fojas, número and año.
  • Identify references for all included property components.

Request the separate charge enquiry

ChileAtiende also describes the certificado de gravámenes y prohibiciones. Its purpose differs from obtaining the ownership inscription with vigencia: it addresses registered encumbrances and prohibitions in the relevant enquiry. Ask the adviser what certificate scope and supporting entries are required for the purchase.

For a mortgage or another entry needing explanation, ask what evidence is needed and how it affects the planned transaction. A seller’s verbal assurance that an obligation was paid should remain a claim to investigate until the adviser has the appropriate documentation. Keep property-use and physical questions in separate rows.

Fictional example: a home with an old loan reference

This invented case illustrates the questions to organise; it is not a Chilean title opinion.

Ownership evidence arrives before the charge enquiry

A buyer receives the ownership inscription and matches its references to the home. The seller mentions a previous loan. The buyer asks the adviser which charge certificate and supporting documents are needed to examine that statement.

The worksheet records the two enquiries separately. It does not treat receipt of the ownership copy as completion of the mortgage question, nor infer that a historic loan remains outstanding solely because the seller mentioned it.

Finish a property-specific investigation

Arrange appropriate checks on condition, access, measurements and intended alterations. Ask the adviser which registry documents should be refreshed and which unresolved questions affect signing or payment. A conservador’s document does not inspect a roof or determine the repair budget from the listing photographs.

Use the Chile listing links below to compare homes and land on a consistent inclusion and area basis. Record the competent local office for each candidate. MarkMyProperty helps with property discovery and comparison; its map pin does not certify legal boundaries, registry entries or permission for building work.

Frequently asked questions

What do fojas, número and año identify?

They are the inscription references used in the ChileAtiende Santiago service. Check them against the particular property documents.

Is dominio vigente the same as a charge certificate?

No. ChileAtiende describes a separate certificado de gravámenes y prohibiciones. Ask your adviser which documents and scope are needed.

Does this cover every conservador in Chile?

The cited service guidance covers Santiago. Confirm the competent office and its process for property elsewhere.
