Cambodia Property Buying: Land Title vs a Co-Owned Building Unit

Separate Cambodian land ownership from private-unit rights in a co-owned building and prepare title, unit, eligibility and cadastral-information questions.

By MarkMyProperty · Updated

Coverage: Cambodia official land, co-owned-building and cadastral-service sources; current eligibility, property registration and transaction requirements need individual professional advice.

Identify what the seller is offering

Cambodia’s official Land Law text distinguishes land rights and cadastral evidence, while the separate law on foreign ownership of private units in co-owned buildings concerns a particular building-unit route. Start by asking whether the offer concerns land, a building unit, a lease or another interest.

Do not let an advertisement’s general word “ownership” replace the actual property-interest description. Ask for the land or unit documents and a competent explanation of the seller’s authority. A condominium marketing name does not by itself establish the registration of the building or the particular unit offered.

Keep land and private-unit eligibility separate

The Land Law’s ownership framework and the private-unit law provide different legal contexts. The latter describes foreign ownership rights in eligible private units, with limits on their location within the building and other conditions. Ask the adviser which current rule applies to the actual buyer and unit.

This distinction is not a promise that every foreign purchaser can acquire every advertised condominium. Nor should a private-unit route be presented as unrestricted ownership of the underlying land. Keep eligibility, the registered unit description and the offered transaction in separate rows until their relationship is explained.

  • Describe the offered land, unit, lease or other interest.
  • Collect the relevant registration documents.
  • Ask for current buyer and property eligibility advice.

Choose the appropriate cadastral enquiry

The Ministry of Land Management, Urban Planning and Construction publishes a current cadastral-service catalogue, including information services. Use the competent authority and transaction adviser to identify the appropriate enquiry and supporting documents for the property rather than relying on an informal title label.

Ask which references connect the land parcel, co-owned building and unit where relevant. Keep the scope and date of information supplied. If an advertised parking or shared-space arrangement is unclear, request the relevant documents and explanation rather than assuming the brochure establishes the included rights.

Fictional example: a unit advertised to an overseas buyer

This original exercise makes no finding about a Cambodian development, quota or purchaser.

Fictional interest-and-eligibility file

The buyer asks which registered unit is being offered

An overseas buyer shortlists a unit described as a condominium. The adviser asks for the building and unit registration evidence and explains the eligibility questions for the proposed buyer and particular unit.

The worksheet keeps the private-unit interest, underlying-land context, shared arrangements and any accessories separately labelled. The buyer does not treat a developer’s assurance as a substitute for the current legal and cadastral evidence required.

Complete the practical purchase file

Arrange appropriate condition, access, measurement and intended-use investigations. Ask which rights, charge and supporting-document enquiries must be completed before commitment. The presence of a cadastral document does not inspect the structure or approve every proposed use of a unit.

MarkMyProperty supports discovery and comparison; its map pin does not certify cadastral status, foreign-buyer eligibility, legal boundaries, unit registration or seller authority.
