Azerbaijan Property Buying: Ownership Extract and Encumbrance Reference

Separate an Azerbaijani property ownership extract from the reference on rights and encumbrances, and prepare current documents and authority questions before buying.

By MarkMyProperty · Updated

Coverage: Azerbaijan property-register and ASAN service guidance; the relevant transaction, property type and applicant authority must be checked individually.

Identify the extract and the exact property

Azerbaijan’s official property-register guidance describes the formalisation of registered rights through an electronic extract from the state register. Ask the seller for the extract and the precise registry and property references relevant to the proposed purchase.

Keep the advertised apartment, parking, storage and any additional land on separate lines. A technical description and the registered right are connected enquiries, but they are not interchangeable documents. Ask the adviser to explain which papers establish each included component.

Distinguish ownership evidence from the current enquiry

The official register guidance describes a separate certificate concerning the property description, registered rights and restrictions for the relevant notarial process. ASAN also lists a reference-note service concerning registered rights and encumbrances. Ask the transaction adviser which current information is needed in addition to the seller’s extract.

Keep the issue date and requested scope visible. An authentic ownership extract made earlier does not automatically answer a later question about charges or restrictions. Ask how the relevant information will be obtained and checked close to the proposed transaction.

  • Match the registry reference with the intended property.
  • Separate the ownership extract from rights and encumbrance information.
  • Record issue dates and the supporting-document questions.

Use the appropriate authorised request

ASAN’s reference-note guidance identifies the right holder and appropriately authorised or otherwise eligible applicants for the service. Follow the applicable instructions through the seller and transaction adviser. Do not assume that a public service listing grants unrestricted access to another person’s property file.

If someone represents the seller, ask the adviser to investigate the relevant authority alongside the property documents. Keep a power-of-attorney question separate from the ownership enquiry. A person’s possession of a copy does not, by itself, explain what transaction they can undertake.

This original exercise does not describe an Azerbaijani property or notarial determination.

Fictional authority worksheet

An extract is supplied by an agent

A buyer receives an electronic extract from someone acting for the seller. The buyer records the property reference and asks the adviser which current rights information and representation documents are required.

The worksheet keeps ownership evidence, the current encumbrance enquiry and authority to act on different lines. The proposed sale is not marked ready merely because the same agent supplied all three descriptions verbally.

Complete the physical and use enquiries

Arrange suitable condition, boundary, access and intended-use checks. Ask about transaction requirements for the actual buyer and property type before committing. A register document does not inspect the building or establish that every interested buyer can acquire the offered interest on the same terms.

Frequently asked questions

Is an ownership extract the same as an encumbrance reference?

Keep them as separate document purposes. The official guidance describes ownership registration and a further enquiry into description, rights and restrictions.

Can any buyer obtain every reference-note document?

ASAN describes eligible applicants and authority requirements. Arrange the appropriate enquiry through the seller and transaction adviser.

What if an agent supplies the extract?

Ask the adviser to check the property information and the agent’s authority separately, using the documents relevant to the proposed transaction.
