Slovenia: tax on a transfer of real estate

The Financial Administration says the real-estate transfer tax is 2 percent and is usually paid by the seller. A capital-gains tax is a separate charge. A land-book entry check is a different document.

Coverage: Slovenia. The Financial Administration page for residents on buying and selling real estate, fetched on 2 November 2026. It is not the land-book entry guide.

The search is davek na promet nepremičnin

On 2 November 2026, the Financial Administration page Nakup in prodaja nepremičnine, in the section for residents, was fetched. It says that on a sale the seller is liable for the real-estate transfer tax, and in certain cases also for personal income tax on a capital gain. The capital-gains tax is determined if the real estate was disposed of before fifteen years of ownership had passed. The seller files the transfer-tax return within 15 days of concluding the contract, at the financial office for the area where the real estate lies, and attaches the original contract and proof of ownership if that is not apparent from the land book.

The page says the payer of the transfer tax is usually the seller. The buyer can be the payer if the seller and the buyer so agree in the contract, in which case the decision is also served on the buyer, and the page says that in that case only the buyer pays the tax. After the return, the tax authority assesses the tax at 2 percent of the value of the real estate. The base is the sale value if it corresponds to the comparable market value. After payment, the authority issues a certificate that the assessed tax was paid. Without that certificate, the signatures on the contract cannot be certified by a notary and the ownership right cannot be entered in the land book. The tax is revenue of the municipality where the real estate lies.

A home lived in for three years is a different line

The same page says the base of the capital-gains tax is the difference between the value of the capital on disposal and its value on acquisition. The rate is 25 percent, and it falls for each completed five years of ownership: 20 percent after five years and 15 percent after ten years. After fifteen years of ownership that tax is not paid. If a person sells a flat, or a house with at most two dwellings and the belonging land, where that person had a permanent residence, owned it, and actually lived there for at least the last three years before the sale, the person is liable only for the 2 percent transfer tax and not for the capital-gains tax.

Those sentences are that Financial Administration page. They are not the land-book guide, which was not rewritten. A pin or a contact reveal does not establish title, and a sale price is the base only where it corresponds to the comparable market value. This page does not set out a return.
