San Marino: registering a transfer of real estate

On 2 November 2026, the service charter of the Ufficio del Registro e Conservatoria was fetched. The charter says it was updated on 9 July 2025. Registration of acts and contracts attests the existence of public acts, gives a private act a certain date, and preserves it, under Law No. 85/1981. Every contract must be registered, at the request of the parties, whether it is a public act, a private writing, or an authenticated private writing. For a public act the notary requests registration. For a private writing the parties do. Every act or contract is brought for registration within 30 days of its execution, subject to exceptions in Delegated Decree 55/2017, article 1. The act must be in Italian, or accompanied by a translation, and signed in original. The assessed taxes are paid, and they vary according to the nature of the contract. No registration can be carried out without prior payment of the taxes.
The charter says the office classifies the transaction and, once payment is made, registers it. The computer register starts on 1 January 2002. A registered private act is not open to third parties. The office cannot issue a copy of a notarial act, because that remains with the notary who received it. A transfer of a real right, its modification, or its extinction is subject to the publicity duties of the notary and the parties under the mortgage law of 16 March 1984 and Law No. 87/1981 on transcriptions.
A value check can follow within ten months
The same charter describes a fiscal check for the possible recovery of tax on a gratuitous or onerous transfer of real estate. Within 10 months of registration of every such act, the office checks that the declared value is congruent with values declared in other acts and with valuations in similar cases. If the value assessed by officials of the Registry and of the Cadastre exceeds the declared value, the taxpayer receives a notice. The taxpayer has 30 days to reach a settlement or to appeal. After that period the assessed value becomes final. An appeal against the revaluation is filed in two original copies with the Registry and Conservatoria, addressed to the Permanent Census Commission. The charter says the appeal costs 60 euro in practice fees, or 30 euro if started electronically. On the difference in value, whether settled or become final, complementary taxes are due, together with penalties. The charter does not print the rate of those taxes or of those penalties.
MarkMyProperty is operated by MMYP TECHNOLOGIES (OPC) PRIVATE LIMITED. Head office: Delhi NCR, India. It charges no platform brokerage commission. A pin, a user-drawn outline, or a contact reveal does not establish title or ownership.
Those sentences are that service charter. They are not the Catasto Web guide, which was not rewritten. A pin or a contact reveal does not establish title, and a declared price is not the final value when the office assesses a higher one. This page does not set out a registration.
