Belarus: state registration of a sale of immovable property

Law No. 133-Z, in the edition of 5 December 2024, says a sale of immovable property that must be registered is concluded from state registration. A My Kut result is a different record.

Coverage: Belarus. Law of the Republic of Belarus of 22 July 2002 No. 133-Z, edition of 5 December 2024, and the National Cadastral Agency registration FAQ fetched on 2 November 2026. It is not the My Kut characteristics guide.

The search is государственная регистрация купли-продажи

On 2 November 2026, the text of the Law of the Republic of Belarus of 22 July 2002 No. 133-Z, in the edition of 5 December 2024, was fetched from the National Cadastral Agency upload. Article 10(1) says state registration of a transaction with immovable property is the legal act by which the state recognises and confirms that the transaction was made. Article 10(2) says contracts that are, or may become, the basis for creation, transfer, or termination of rights or encumbrances that are themselves subject to registration are subject to registration. The list includes contracts of alienation: sale, exchange, gift, rent, and others.

Article 10(3) says a transaction with immovable property that is subject to state registration is considered concluded from the moment of state registration, unless legislation provides otherwise. Article 10(4) says the persons concerned must apply for registration of such transactions within not more than six months from the day they are made in proper form, except transactions with residential premises, whose time limits are set by housing legislation, and other cases set by legislation. Article 10(5) says leases, subleases, and gratuitous use of capital structures, isolated premises, and parking spaces are not subject to state registration and are considered concluded from the day the parties sign them.

A preliminary contract is a different document

The National Cadastral Agency registration FAQ, fetched the same day, says documents that can be the basis for registering ownership of a dwelling include a contract of sale, gift, or exchange, an inheritance certificate, a court order, and other documents on which ownership arises or passes. On a preliminary sale contract, the FAQ says it is not subject to state registration. It cites Civil Code article 399(1): the parties undertake to conclude a future main contract. The FAQ cites paragraph 3 of article 9 of the registration law for the rule about which contracts are registered, and paragraph 2 of article 8 for the rights. The edition of 5 December 2024 fetched above states the list of contracts in article 10(2) and the rule that a registrable transaction is concluded from registration in article 10(3). This page does not force the FAQ’s article numbers onto that edition.

MarkMyProperty is operated by MMYP TECHNOLOGIES (OPC) PRIVATE LIMITED. Head office: Delhi NCR, India. It charges no platform brokerage commission. A pin, a user-drawn outline, or a contact reveal does not establish title or ownership.

Those sentences are that edition of Law No. 133-Z and that FAQ. They are not the My Kut guide, which was not rewritten. A pin or a contact reveal does not establish title, and an extract is a record of what was registered at the time it was issued. This page does not set out an application.
